In 1996, Brais Law Firm's founding attorney Keith Brais obtained his first ever Florida Bar certification in the field of maritime and admiralty law, and every five years since, he has successfully renewed his certification. Before beginning his career as a litigator, however, Keith Brais had substantial firsthand experience with marine employment. He graduated from the Massachusetts Maritime Academy with a B.S. degree in marine engineering, obtained multiple maritime work certificates and three US Coast Guard licenses, and spent more than seven years working as a merchant seaman aboard commercial ships and offshore oil rigs.

Keith Brais is a member of the Standing Committee for the Florida Bar. All members are appointed by the Florida Bar’s President-elect of that incoming year. The scope and function of the Admiralty Law Committee is to study and keep members of the Bar informed of recent developments in the field of admiralty law. The committee along with the Rules Committee reviews and studies the portions of the Federal Rules of Procedure and United States Code relating to admiralty matters. The committee also reviews local rules relating to admiralty matters in the various United States district courts in Florida. The committee may study and consider matters in the area of admiralty law and procedure as may be developed by the committee or assigned by the president or Board of Governors and assist in developing continuing legal education courses for persons designated in admiralty law. The committee meets twice a year to discuss current topics of admiralty law facing Florida Lawyers.

Fort Lauderdale Mariners Club Member & Lecturer

Keith Brais is a member of the Fort Lauderdale Mariners Club (“FLMC”). FLMC was formed in 1989 and is a non-profit, non-political organization among maritime industry professionals and attorneys to encourage high standards of business practice throughout the community and to provide a forum to improve the marine industry in South Florida.

The focal point of the Club’s activities is the marine seminar held prior to the Fort Lauderdale Boat Show in October of each year. The first marine seminar, held in 1989, was attended by more than 150 people. Today, the seminar draws more than 500 participants from all walks of the marine community. The interesting slate of speakers, coupled with the opportunity for attendees to interact with each other in a vibrant setting, had made the marine seminar a truly international event.

In 2002 and 2006 the Club’s member honored Keith Brais by requesting that he lecture at the fall seminar. “To Deny Coverage or Not Deny Coverage” was the paper presented at the 2002 seminar, discussing various underwriting issues when deciding to accept coverage for marine losses. Maritime Law Association of the United States-Proctor Member

Keith Brais has been a “Proctor in Admiralty” of the Maritime Law Association (“MLA”) since 1998. The objective of the MLA is to, among other things, advance reforms in the Maritime Law of the United States. The MLA membership consists of lawyers involved in maritime matters, judges active in matters involving admiralty issues, admiralty law professors, and non-lawyers who are selected because they hold responsible positions in the maritime field and have rendered distinguished service in the advancement of maritime law or its administration. The designation “Proctor in Admiralty” is of ancient origin and applied to lawyers entitled to handle maritime litigation. The designation was continued in the American colonies and, until recently, in our federal court system. Though no longer in official usage, “Proctor” is intended by the MLA to designate the most distinguished class of membership for practicing maritime attorneys.

Attorney Name this past year was selected as a “Rising Star”. In 1998, the publishers of Law & Politics and Super Lawyers launched Rising Stars to recognize the top up-and-coming attorneys (those younger than 40 or have been practicing less than 10 year) in each state. Like Super Lawyers, Rising Stars are attorneys in each state who received the highest point totals in a rigorous multiphase process considering a wide range of objective indicators including peer recognition and professional achievement. The Selection Process
The Rising Star employs a two-stage selection procedure consisting of a general survey of practicing lawyers and research process.

The General Survey
In the general survey, practicing attorneys are asked to nominate the best attorneys who are 40 or under, or who have been practicing for 10 years or less. These attorneys are instructed to nominate lawyers they have personally observed in action — whether as opposing counsel or co-counsel, or through other firsthand courtroom observation.

The Research Process
In addition to the general survey, the attorney-led research team reviews the credentials of potential candidates and assigns points based on a set of defined evaluation criteria. The research staff also confirms that nominees are properly licensed, in good standing with the state licensing agency, and, when possible, that they have no history of disciplinary action that would warrant removal from the list.

The Final Selection Process
The point totals from the general survey and research process are then added to arrive at a final tally. The lawyers are ranked by point totals and those with the highest point totals are named to the Rising Stars list.

7 Years Aboard Offshore Oil Drilling & Exploration Rigs

Keith Brais, perhaps more than any attorney, appreciates the dangers associated with working offshore. After graduating from Massachusetts Maritime Academy with a Bachelor of Science Degree in Marine Engineering, Keith Brais was recruited by the world’s largest off-shore oil drilling and exploration contractor, which at that time was SEDCO. As a part of his training, he began working as an engineer trainee eventually moving through the ranks from roustabout, roughneck, derrick hand and finally an assistant driller (second in command of drill floor operations). In the course of his training, Keith Brais acquired an MMSS-OCS-TI: Well Control, Surface Stack & Subsea Stack, Blow-Out Prevention (“BOP”) Course, Driller Level Certificate.

He worked in the Mediterranean, off the West Coast of Africa and in the Gulf of Mexico on essentially every known type of offshore drilling platform. Keith Brais’ experience includes time working directly on Cameron blowout preventers, tripping pipe, running casing, lowering and raising sub-sea BOPs, setting cement plugs, testing wells and all other aspects of oil drilling and exploration.

Southeastern Admiralty Law Institute-Member & Lecturer

Keith Brais is a member of the Southeastern Admiralty Law Institute (“SEALI”). SEALI was formed 1968 for the purpose of organizing a forum for the discussion of admiralty and maritime law and its practice and administration, among practitioners in the ports of the Southeastern United States. Regular membership is limited to attorneys admitted to practice in the states of: Virginia, North Carolina, South Carolina, Florida, Georgia, Alabama, Tennessee, Mississippi, Louisiana, Texas, and Maryland. Attorneys from other states and any citizen of the United States who is not an attorney may join under special membership status. Each year SEALI holds a seminar at which leading maritime practitioners meet and earn Continuing Legal Education credits. In 2006, Keith S. Florida Legal Elite

Keith Brais has been selected by his peers as a “Florida Legal Elite.” Florida Legal Elite presents a prestigious roster of attorneys chosen for recognition by their peers, attorneys who exemplify a standard of excellence in their profession and by so doing, have garnered the respect and esteem of their colleagues.

Florida Trend invited all in-state members of the Florida Bar to participate in the voting process. Multiple announcements publicized the ballot deadline and voting guidelines. Lawyers were asked to name attorneys whom they hold in the highest regard or would recommend to others.

The ballots were processed, checked and tabulated by Bradenton-based Outsource America and EA Fernbacher LLC in St. Petersburg. Each lawyer was given a score based on the number of votes he or she received, with more weight given to votes from outside the firm. The list of top vote-getters was further examined using membership status and histories provided by the Florida Bar. A panel of previous Legal Elite winners, representing different practice areas in cities across the state, reviewed the selection process and the list of finalists.

The resulting lists represent fewer than 2% of the active Florida Bar members who practice in Florida.
