Crew on Passenger Sexual Assault/Rape Claims

Cruise ships are obligated to provide a reasonably safe place. When a crew ship employee, namely a crew member, perpetrates a crime such as a rape or a sexual assault, the cruise lines are strictly liable for those acts. It no longer is the burden on the part of a cruise passenger or an attorney representing a cruise passenger to prove that the cruise line either knew or should have known of this propensity of a particular crew member. That no longer is the burden of proof. It’s strict liability.

The only thing that a cruise passenger, at that point, needs to prove is that the event occurred, that it was non-consensual and that there are resulting damages and harm. These are very, very traumatic events, physically, mentally, emotionally, and something the firm has handled for nearly 30 years.
